PRIZE DRAW TERMS AND CONDITIONS

1. PROMOTER. The promoter is: Ros Roca SA of Av. Cervera s/n, 25300 Tàrrega, España (“Ros Roca”).
2. PRIZE DRAW. The title of the prize draw is: OLYMPUS MODEL. There is ONE available prize offering and ONE winner shall be selected twice per year, the 30 of June and the 31 of December. The prize offering is: a 1:76 scale model of the Olympus refuse collector vehicle.
3. START/CLOSE DATE. The opening date for entries to this prize draw is 8:00 am on 01.04.25. The closing date for entries to this prize draw is 12.00 pm on 31.10.25 and 31.03.26 Entries received outside of such dates shall not be counted, valid, accepted and/or considered.
4. ENTRY RESTRICTIONS. This prize draw is open to all European residents aged 18 years or over, except employees of Ros Roca (or any group company), their families, agents or any third party directly associated with the administration of the prize draw. Upon purchase of PRODUCT/SERVICE you will be automatically entered into the prize draw. All entries must be submitted by Micrososft Forms and there is a limit of one (1) entry per person. Proof of eligibility may be required.
5. LOST, DELAYED OR VOID ENTRIES. Ros Roca accepts no responsibility for entries not successfully completed due to any failure or fault of any kind, including (without limitation) any issues arising out of or in connection with any computer equipment, software, network, website, application and/or postal service. Ros Roca will not accept any entry which is automatically generated by a computer program of any kind, completed by third parties or in bulk, illegible, altered, reconstructed, forged or tampered with, not an original submission, or incomplete.
6. WINNER SELECTION. The winner shall be selected at random from all eligible participants by the prize draw administrator shortly after the closing date for entries.
7. WINNER NOTIFICATION. The prize draw administrator shall make all reasonable efforts to contact the prize draw winner (as soon as practicable after the closing date, using details provided at entry) to arrange for delivery or collection of the applicable prize offering. If a winner does not respond to the prize draw administrator within a reasonable time period (at the prize draw administrator’s sole discretion), the relevant prize offering shall be forfeited and Ros Roca shall be entitled to select a replacement in accordance with these terms and conditions. In order to indicate that a valid award took place, Ros Roca may: (i) publish the name of the prize draw winner on its social media channels as soon as practicable after the closing date; or (ii) provide the name and entry details of the prize draw winner to any applicable supervisory or regulatory body (on request).
8. PRIZE SUBSTITUTION. Ros Roca reserves the right to suspend, postpone or cancel the prize draw at any time, or to provide an alternative prize offering of equal or greater value, at its discretion and without liability to participants, to each winner.
9. DECISIONS. Any decision regarding any aspect of this prize draw shall be final and binding, and no correspondence will be entered into. This may include disqualification if conduct is contrary to the spirit or intention of the prize draw.
10. PERSONAL INFORMATION. Any personal data provided by a participant shall be handled in accordance with applicable data protection laws and Ros Roca’s privacy policy, available at: https://www.rosroca.es/. It is intended that personal information provided shall only be used for the purpose of administering this prize draw and not for any other purpose (including marketing).
11. ACCEPTANCE. All eligible participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. Ros Roca reserves the right to refuse entry or refuse to award any prize to anyone in breach of these terms and conditions.
12. LIABILITY. Insofar as is permitted by law, Ros Roca, its agents or distributors will not in any circumstances be responsible or liable to compensate a winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by Ros Roca’s negligence, its agents or distributors or that of their employees. Statutory rights shall not be affected.
13. INTELLECTUAL PROPERTY. If applicable, all prize draw entries will become the property of Ros Roca on receipt and will not be returned. By submitting the prize draw entry and any accompanying material, each participant agrees to: assign all intellectual property rights held in the prize draw entry with full title guarantee to Ros Roca; and waive absolutely all moral rights, in and to the prize draw entry and otherwise arising in connection with the entry to which may now or at any time in the future be entitled under any applicable laws in force from time to time. Where applicable, each participant agree that Ros Roca may, in its sole discretion, make any available on its website and in any other media, whether now known or invented in the future, and in connection with any publicity of the prize draw. Each participant grants Ros Roca a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the prize draw entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the prize draw entry for such purposes.
14. JURISDICTION. This prize draw shall be governed by Spanish law and participants to it submit to the exclusive jurisdiction of the Spanish courts.
15. PERSONAL INFORMATION. The data of the raffle participants and winners will be processed in accordance with the provisions of the General Data Protection Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD). In compliance with the provisions of Articles 13 and 14 of the GDPR and Article 11 of the LOPDGDD.     Ros Roca SA will establish the necessary technical and organizational measures to guarantee the security required by the automated files, processing centers, premises, equipment, systems, programs, and people involved in the processing of personal data in the manner required by law and regulations. Participation in this raffle implies the express consent of participants for their data to be included and processed in the aforementioned file.
